
Peak Potentials Training ("PPT") is pleased to present the One Story, Many Lives / Graduate Stories Video Testimonial Contest.
The contest is governed by the rules set out below. By entering the contest, you agree to abide by those rules and the decisions of PPT and the contest judges. You also agree to comply with all applicable laws. The contest is void where prohibited or restricted by law.
THE RULES
1. Contest Period
The contest runs until 12:01 AM Pacific Time on March 31, 2010. Entries must be received by PPT within this period to be eligible.
2. How To Enter
You may enter the contest by submitting your video to PPT as follows:
- Go to YouTube at http://ca.youtube.com/ and click "Upload". If you are a YouTube member, login and upload your video to your YouTube account. If you are not a YouTube member, follow the instructions to sign up for membership (there is no fee to become a member), and then upload your video to your YouTube account. If you customize your video information, please make sure your Broadcast Options are set to "Public – Share your video with the world! " and your Sharing Options for "Embedding" is set to "Yes” so that external sites may embed and play this video.
- After uploading your video to your YouTube account, visit the contest "Add New Video" page at www.peakpotentials.com/graduatestories to register and submit your video for the contest. You will be required to provide your contact information, the name of your video, your video's unique YouTube URL, and agreement to these Rules. You are solely responsible for ensuring that all information is up-to-date and accurate.
- After submitting your video, you will be redirected to a confirmation page.
It is solely your responsibility to ensure that your video is properly registered as described above. PPT will not be responsible for any lost, delayed, misdirected, illegible, incomplete, damaged or undeliverable entries, or any delay or failure to transmit, process, receive or consider entries.
Please note that PPT is not associated with YouTube. You must comply with YouTube's terms of use, and PPT will not be liable to you regarding your use of (or inability to use) YouTube.
3. Eligibility — Entrants
You are not required to make any purchase or pay any fee to enter or win the contest.
You may only enter the contest if you are an individual and, at the time of entry you are: (1) a legal resident of Canada or the United States and (2) 18 years or older.
PPT employees and their immediate families (i.e., their spouses, siblings, children, spouses' parents, and the spouses of any of those individuals) and their household members (related or not), and anyone otherwise connected with the contest, are not eligible to enter the contest.
PPT may at any time in its sole discretion disqualify any entrant who: does not meet the contest's eligibility criteria, fails to comply with these rules, attempts to enter the contest in any manner or through any means other than as described in these rules, attempts to disrupt the contest or attempts to circumvent any of these rules.
4. Eligibility — Videos
Your video must meet all of the following criteria to be eligible for the contest:
- It must meet all guidelines and criteria imposed by YouTube with respect to videos submitted to YouTube.
- It must be focused on highlighting: Achievements in your personal life as a result of PPT training, from reconnecting with a loved one to making strides with your own personal goals; Quantifiable successes in your business or career that can be attributed to what you’ve learned from PPT; How you been inspired by a Peak Potentials Training course or camp? How has your life been transformed? How did you manifest change?
- It must not contain, depict or refer to any crude, vulgar, obscene, sexually explicit, disparaging, discriminatory, offensive, illegal or otherwise unsuitable language, activity or other content (all as determined by PPT in its sole discretion).
- It must not contain, depict or refer to any content which disparages or refers negatively to PPT, the contest, or any other person or entity (all as determined by PPT in its sole discretion).
- It must not conflict with any of PPT’s core values, or otherwise be objectionable to PPT (as determined by PPT in its sole discretion).
- It must not contain any content that violates any law or any third party's rights (including privacy, personality and intellectual property rights).
- It must comply with the other requirements listed below under the "Video Contents" heading.
- It must not promote, depict or refer to any commercial enterprises. Nor should it contain URLs or logos laid over the video footage.
- It must not be a video previously submitted as a Graduate Stories entry.
PPT may disqualify any video entry if PPT determines (in its sole discretion) that the video does not comply with these eligibility requirements or otherwise with these rules.
5. Video Contents
Your video may be in colour or black and white, and may be enhanced with graphics, special effects or animation.
The video must meet the technical specifications required for it to be uploaded to, and received by, the contest web site at www.peakpotentials.com/graduatestories by the end of the contest period.
By submitting a video to PPT you represent and warrant that:
- you are the original creator of the video;
- you are the sole owner of the copyright and all other rights in the video and all content in and on the video;
- PPT will not infringe or violate any third party's intellectual property, privacy, personality or other rights when PPT copies, displays, edits, modifies, transmits or otherwise uses that video in connection with the contest or any advertising; and
- the video meets all of the eligibility requirements set out in these rules.
If PPT suspects or believes that any of the above is untrue, PPT may disqualify your entry in its sole discretion.
6. Subject and Participant Releases
If a video shows any individual in such a way that the individual can be recognized, you must obtain written consent from that individual to permit PPT to copy, display, transmit and otherwise use the video, and you must give PPT the original copy of that consent upon PPT’s request. Videos that are submitted with inadequate documentation, as determined solely by PPT, will not be eligible for the contest.
7. Voting and Judging Process
Online Public Voting to Determine Finalists
During the contest period, the public may vote for their favourite video entry by following the instructions on the contest website. Voting will open to everyone, but there is a limit of one vote per video per person. If PPT discovers that an individual has voted more than once for the same video, PPT may disqualify some or all of that individual's votes in PPT’s sole discretion.
Voting will end on or around March 31, 2010 at 8:00 AM Pacific time. The videos with the most votes at the end of the voting period will each be selected as one of the ten contest finalists. If a finalist video is disqualified or deemed ineligible by PPT, that video will not be considered for a prize, and the finalists will be the remaining, plus the video with the next-highest number of votes (e.g., if one of the top 5 videos is disqualified, then the sixth-highest video will become a finalist). Once all 10 finalists have been identified, PPT will notify the finalists of their finalist status, and will post the PPT finalist videos on the contest website (PPT expects to do so on or around April 10, 2010).
Judging of Finalists
PPT will select the judges in its sole discretion. The contest's judges will select the finalist videos based on the following criteria:
· 50% - Viewer votes through YouTube (highest overall score based on number of votes and value of each vote)
· 50% - Peak Potentials Training judging
The judges' decisions will be based on the following criteria (weighted equally), and will not limited or restricted:
- Originality: how are you delivering your story?
- Authenticity: are you speaking from the heart?
- Inspiration: does it make a compelling case to viewers?
- Overall presentation: what is the overall impact?
The judging will be completed by January 10, 2010. Decisions of the contest judges will be final and binding.
8. Winners
The entrant of the winning video will be notified by email. In order for this finalist to be declared the contest winner and be eligible for the first place Best of Show prize, the winner must have complied with, and remain in compliance with, these rules, and must sign and deliver to PPT (within 5 days of PPT’s request) a standard declaration and release form (which will include a declaration of the finalists' compliance with these rules, an acceptance of the prize as awarded, a publicity release, a liability release, and the correct answer to a skill-testing question) and any other documentation that PPT may require.
PPT may request valid proof of identity, residency, age and other relevant documentation, and PPT may disqualify the winner if PPT determines (in its sole discretion) that the provided proof is not sufficient.
If the prize notification is returned as undeliverable, or if the selected winner does not comply with all of the above requirements within the above time frames, or does not otherwise comply with these rules, the finalist will be disqualified and the contest judges will select a replacement winner.
The chances of winning will depend upon the number of entrants.
PPT expects to announce the name of the winner on or around April 15, 2010.
9. Prizes
One Best of Show prize to be won - $2,000 check. The Best of Show prize will be awarded to the top scoring entry (as chosen by the contest judges) as defined above.
PPT will also award each individual video entry that is not selected as the Best of Show winner with one (1) PPT Tuition Voucher in the amount of $250. Vouchers have no actual cash value and may only be used towards PPT courses or camps (excluding products, food, and accommodations).
All prizing will be awarded in either USD or CAD as the currency of the winner’s home country.
All prizes must be accepted as awarded (with no substitutions), and may not be sold, transferred, or converted into cash.
10. Cancellation
If for any reason PPT cannot run the contest as planned, (including as a result of bugs, tampering, unauthorized intervention, fraud, technical failures, infection by computer virus or any other cause that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this contest) PPT may cancel, modify, extend or suspend the contest. In that event, PPT may award prizes at random from among the eligible entries received up to the time of the impairment, or award no prizes.
PPT may also disqualify any individual who tampers with or in any way corrupts the entry or voting process, or who attempts to undermine the legitimate operation of the contest by cheating, hacking, deception, or other unfair practices, or by attempting to annoy, abuse, threaten or harass any other entrants or PPT representatives.
11. License to PPT
By entering a video in the contest, you waive all rights you may have with respect to the video, including all moral rights and rights of personality, publicity or privacy, and you grant to PPT the unrestricted, royalty-free, perpetual, irrevocable, worldwide license (but not the obligation) to use, reproduce, communicate, modify and display the video (in whole or in part) for any purpose without any fee or other form of compensation, and without further notification or permission, including without limitation the following purposes:
- reproducing, publishing, communicating and displaying some or all of the video as part of the contest or otherwise;
- identifying you by name as the owner of the video;
- judging the contest;
- displaying the winning entries in the contest; and
- for PPT’s advertising purposes, including to advertise the contest, future contests, and PPT's products and services.
12. Modifications
You grant to PPT the unlimited right: (i) to edit or modify your video in any manner, including by adding visual or aural effects or other elements; and (ii) to use, adopt and modify any or all portions of your video in combination with other materials. When editing or modifying your video, PPT will use commercially reasonable efforts to maintain the original essence of the video.
13. Disclaimers, Liability, and Indemnification
PPT shall have no liability for any loss or damage of any videos entered in the contest or for any other loss or damage resulting directly or indirectly from your participation in the contest.
PPT is not responsible for: (1) incorrect or inaccurate transcription of entry information or late, lost, incomplete, misdirected entries, or entries received through impermissible or illegitimate channels; (2) technical failures of any kind, including without limitation the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any service; (4) unauthorized human intervention in any part of the entry process or the contest; (5) electronic or human error which may occur in the administration of the contest or the processing of entries; or (6) any injury or damage to persons or property, including without limitation your computer, which may be caused, directly or indirectly, in whole or in part, from your participation in the contest or from downloading any material from PPT's website.
PPT will not be liable to you for any indirect, special, consequential, or punitive damages in connection with the contest or these rules.
By participating in this contest, you release and agree to indemnify and hold harmless PPT and its employees, directors, officers, affiliates, agents, judges and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this contest or receipt or use of any prize.
By participating in this contest, you further agree to indemnify and hold harmless PPT and its employees, directors, officers, members, affiliates, agents, judges and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions or losses of any kind (including actual legal fees and expenses) arising from or related to: (a) your failure to comply with any of these rules; (b) any misrepresentation you make under these rules or otherwise to PPT; or (c) your participation in the contest.
14. Personal Information
You consent to PPT using and disclosing your personal information (as defined herein) for the purposes of administering the contest; advertising the contest and any future contests and any of PPT's products and services; and for the other purposes described in these rules. If PPT uses some or all of your video for advertising purposes, PPT will only disclose your first name in that advertising unless you consent to PPT also disclosing your last name.
15. Law
The Rules will be governed by and construed in accordance with the laws of the Province of British Columbia, Canada and the Federal laws of Canada.
16. Disputes
All disputes, claims and causes of action arising out of or connected with the contest, prizes or these rules will be resolved individually, without resort to any form of class action, and exclusively by the appropriate court of the Province of British Columbia, Canada, in Vancouver, British Columbia.
17. Quebec Residents
In Canada, with respect to Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
18. Language
The parties have expressly requested that this Agreement and any related document be prepared in the English language. Les parties aux présentes ont expressément demandé à ce que cette convention et les documents qui s'y rapportent soient rédigés en anglais.
